1 - FIELD OF APPLICATION<\/h6>

These conditions are concluded between, on the one hand, the company SAS B AMAZING, publisher of the magazine AMAZING BEAUJOLAIS and of the website http:\/\/amazingbeaujolais.fr, registered with RCS Villefranche-Tarare under number 901 885 020 and located at 60 lot les Vignes du Montjoly, 69430 Quinci\u00e9-en-Beaujolais France, hereinafter referred to as \u201cB AMAZING\u201d and, on the other hand, persons wishing to make a purchase via the amazingbeaujolais.fr website hereinafter referred to as \u201cTHE CUSTOMER". These conditions apply exclusively to non-commercial individuals. These conditions aim to define the terms of sale between B AMAZING and the CUSTOMER, from the order to the services, including payment and delivery.<\/p>

B AMAZING reserves the right to modify these general conditions of sale at any time. Nevertheless, the General Conditions of Sale applicable to the order placed by a CUSTOMER on the B AMAZING site are those accepted by the Customer at the time of placing his order.<\/p>

3 - RETENTION OF OWNERSHIP<\/h6>

The products remain the property of B AMAZING until full receipt of the price paid by the CUSTOMER. The resale of products purchased on the amazingbeaujolais.fr site is strictly prohibited.<\/p>

4 - PRICE<\/h6>

Les prix des produits sont indiqu\u00e9s en Euros toutes taxes comprises hors participation aux frais de traitement et d\u2019exp\u00e9dition, d\u2019\u00e9ventuelles offres promotionnelles et r\u00e9ductions personnelles, d\u00e9taill\u00e9s avant la validation de la commande par le client et repr\u00e9cis\u00e9s dans la facture \u00e0 l\u2019attention du client, disponible sur demande \u00e0 l\u2019adresse suivante : abclausel@gmail.com<\/p>

B AMAZING reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of the recording of the orders subject to stock available on that date. Any change in the VAT rate can be automatically reflected in the prices.<\/p>

FREE DURATION: With regard to the price of open-ended subscriptions paid by direct debit, B AMAZING may modify the amount of these current subscriptions after having informed the subscriber. 5 - ORDER<\/h6>

The CUSTOMER can place his order at amazingbeaujolais.fr in the website shop 24\/7.<\/p>

Any CLIENT of SAS B AMAZING declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to have the legal majority and not to be protected within the meaning of article 488 of the Code. Civil.<\/p>

Acceptance and confirmation of the order are carried out by entering data on successive screen pages. These data appear on a summary screen which includes an explicit mention of the CLIENT's firm commitment. Once his order has been validated, the CUSTOMER declares to accept all of these General Conditions of Sale without reservation. Orders are confirmed to the CUSTOMER by email. The data recorded by B AMAZING constitutes proof of all transactions made by B AMAZING and its CUSTOMERS. The data recorded by the payment system constitutes proof of financial transactions.<\/p>

These Conditions can be read directly on the amazingbeaujolais.fr site. At the CLIENT's simple request, they can also be sent by e-mail.
The fact that the CUSTOMER ticks the box \u201dI accept the general conditions of sale\u201d, before proceeding to the secure payment, constitutes an irrevocable acceptance which can only be called into question in the cases exhaustively provided for in these general conditions of sale under the paragraph \u201cright of withdrawal\u201d. The Customer acknowledges by this act having read and understood these Conditions and accept them.<\/p>

B AMAZING reserves the right to cancel or refuse any order from a CUSTOMER with whom there is an ongoing dispute or suspicion of fraud.<\/p>

6 - VALIDATION<\/h6>

The CUSTOMER declares to have read and accepted these General Conditions of Sale before placing his order. The validation of his order therefore implies acceptance of these General Conditions of Sale. Unless proven otherwise, the data recorded by the computer systems of the amazingbeaujolais.fr site constitute proof of all communications, orders and payments made between B AMAZING and its CUSTOMERS.<\/p>

7 - TERMS OF PAYMENT<\/h6>

The CUSTOMER can pay for his order online by credit card (Carte Bleue, Visa, Eurocard-Mastercard). The CUSTOMER guarantees the company B AMAZING that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the order form. Purchases are debited from the CLIENT's account when the order is processed.

10 - DELIVERY<\/h6>

The products are delivered to the delivery address indicated by the CUSTOMER during the ordering process. B AMAZING uses La Poste's shipping services throughout France, its overseas communities and the rest of the world.<\/p>

The average delivery times of the Post office may vary depending on events beyond the control of B AMAZING, which cannot be attributed to it and cannot under any circumstances give rise to any deduction or compensation. B AMAZING reserves the right to split deliveries.<\/p>

11 - VAT AND CUSTOMS FEES<\/h6>

For the countries of the European Union and overseas communities, French VAT is applied to the rate excluding taxes. For all other countries, customs duties or other local taxes or import duties or state taxes may then be payable. These rights and sums are not the responsibility of B AMAZING. They will be the responsibility of the CUSTOMER and are their sole responsibility both in terms of declarations and payments to the competent authorities and bodies in their country. We advise them to find out about these aspects from their local authorities.<\/p>

12 - NON-CONFORMITY OF THE GOODS DELIVERED<\/h6>

The CUSTOMER must verify upon receipt the conformity of the products delivered to the products ordered and the absence of any apparent defect. If no complaint or reservation is formulated in this respect by the CUSTOMER within the time limits in accordance with article 1642 of the Civil Code, said products may no longer be returned or exchanged. In the event of an apparent defect or non-conformity of the products delivered to the products ordered (the confirmation e-mail as proof) noted by the CUSTOMER, B AMAZING undertakes to replace the products delivered with new products identical to the ordered. 13 - GUARANTEES AND AFTER-SALES SERVICE<\/h6>

If the product received contains a hidden defect, the CUSTOMER is invited to inform B AMAZING customer service by e-mail as soon as possible. He must then return the goods by post within 30 French working days, attaching any documentary proof (e-mails confirming the order, invoice, delivery slip or any customs documents). The defective item will then be exchanged (within the limits of available stocks). If the product is not available, and in this case only, B AMAZING undertakes to reimburse the CUSTOMER for all the sums paid or to offer him equivalent products in exchange, within a maximum period of 30 days. B AMAZING will not accept any return of products beyond a period of 30 French working days following delivery.<\/p>

14 - WITHDRAWAL - TERMINATION<\/h6>

RETRACTION
In the context of distance selling (without the simultaneous physical presence of the parties), the CUSTOMER has, according to Article L 121-21 of the French Consumer Code, can exercise his right of withdrawal without having to pay penalties if it Ci contracts a subscription on amazingbeaujolais.fr.<\/p>

In the event of a request for reimbursement, B AMAZING will make all possible efforts to reimburse the CUSTOMER within a reasonable period of time.<\/p>

The products offered comply with current French legislation and standards applicable in France. B AMAZING cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the CUSTOMER's responsibility to check with local authorities the possibilities of importing or using the products or services that he intends to order. The characteristics of the products sold on amazingbeaujolais.fr are likely to be modified or improved at any time; the photographs and graphics reproduced illustrating the products presented may exceptionally include minor variations with the product delivered. 17 - APPLICABLE LAW - DISPUTES<\/h6>

This agreement is subject to French law. The language of this contract is French. All disputes relating to the interpretation and execution of this contract will come under the jurisdiction of the Commercial Court of Villefranche-Tarare (France) or that of the jurisdiction of the place of delivery of the order.<\/p>
